Privacy notice

The personal information you provide is collected only to administer the NSW Net Zero Industry and Innovation Program (program). This program is administered by the NSW Department of Climate Change, Energy, the Environment and Water (Department).

The Department may only use your personal information in a way that is consistent with this purpose, which could include contacting you in relation to your application for grant funding. 

We will not disclose your personal details for any other purpose unless the disclosure is authorised by the Privacy and Personal Information Protection Act 1998 (NSW) (PPIP Act). Your consent to disclose personal information for particular purposes may be sought by us, or given by yourself, for a specific purpose. If appropriate consent is not provided, the Department may not be able to assess your application or provide certain products and services to you or your agents. 

We will retain the information you have provided for a period that is appropriate for the purpose for which it was provided. Your information will be archived and disposed of in accordance with the department's policies and legislative requirements of the NSW State Records Act 1998.

Confidentiality and disclosure of information

The Department and its employees, agents and officers (Department representatives) will utilise information collected as part of the application (if applicable) to review suitability

Unless otherwise stated, any commercial-in-confidence information provided by an applicant as part of, or in connection with, an application process will be treated confidentially by the Department.

To assess your application, commercial-in-confidence information provided by you may be disclosed to the following parties:  

  • the Minister or Minister’s office
  • the NSW Department of Planning and Environment
  • the NSW Ombudsman and Audit Office of NSW
  • the Department and its employees, officers, agents, subcontractors, consultants and
  • advisers
  • members of the Assessment Committee
  • external advisors including probity, technical, financial, or legal advisors
  • any agency or body of the NSW Government, or any other organisation or individual considered by the Department to have a need or an entitlement to know that information (including any federal, state or territory agency or body), where that need or entitlement to know that information arises out of or in connection with the Department assessment, verification or due diligence of any aspect of your APPLICATION where authorised or required by law to be disclosed, to those parties.

If we disclose commercial-in-confidence information to any of the above parties, we will inform the party that the information is strictly confidential. We will otherwise only disclose commercial-in confidence information provided by you with your consent.

At the conclusion of the application stage of the funding round, the Department may publish aggregated and non-identifiable data from the applications received. In addition to this, information pertaining to recipients of grants will be published on the online NSW Government's Grants and Funding Finder including, but not limited to recipient name; recipient location; and funding amount.

Joint funding

If you are seeking or receiving funding for this project by the Department and any other government entity (joint funding), you consent to the application and other associated information being shared with any other government entities under a joint funding program.

Limitations

The Department representatives do not give any representation warrant or guarantee, whether express or implied, in relation to the information contained in this application or the HEI funding guidelines 2022-2024  including their completeness, accuracy, currency or reliability or the process by which they were prepared. None of the Department representatives give opinions regarding, legal, accounting, regulatory, taxation or any other matters. Without limiting the foregoing, nothing in the HEI funding guidelines 2022-2024 is or should be regarded as advice in relation to those matters. 

Nothing contained in the program materials including the HEI funding guidelines 2022-2024 or application form may be relied upon as a promise, guarantee, representation, or warranty.
